BUTTE — A couple asleep in their Butte home on Tuesday morning was startled awake by a burglar who jumped on their bed.

Police allege Clayton Kirn entered a home in the 900 block of Main Street at about 2 a.m. and jumped on the bed where a couple was asleep.

Kirn is accused of threatening to kill the wife when the husband woke up and chased the intruder from the home.

Police found Kirn walking in the 800 block of Colorado Street.

“As we were trying to place him under arrest, he took off running south toward the railroad tracks where he subsequently tripped on the railroad tracks and was taken into custody,” said Butte Undersheriff George Skuletich.

Kirn is jailed on charges of felony aggravated burglary and resisting arrest.

According to the Montana Department of Corrections, Kirn has felony convictions in Yellowstone County for assault on a peace officer, and criminal possession of dangerous drugs.
